1. Acceptance of Terms
By using QuickFeedback.ai ("Service", "we", "our"), you ("you", "User", "Client") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms presented to you when using our services. If you do not agree with these terms, do not use the service.
2. Eligibility
You must be at least 18 years old to use QuickFeedback.ai. By using this Service, you confirm that you are at least 18 and have the legal authority to accept these terms.
3. Description of the Service
QuickFeedback.ai provides digital tools for businesses to collect customer feedback using QR codes and AI-driven analysis. Key features include:
- QR code generation for collecting responses
- AI-driven follow-ups (e.g., thank-you, apology messages)
- Feedback dashboards and basic analytics
- Optional routing to public review links (at user discretion)
We reserve the right to modify or discontinue any part of the Service at any time with or without notice.
4. Account Registration
To access business tools, you must register for an account. You agree to provide accurate, current, and complete information, and keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities that occur under your account.
5. User Conduct
You agree not to use QuickFeedback.ai to:
- Violate any laws or regulations
- Transmit harmful, offensive, or misleading content
- Interfere with the integrity of the system
- Attempt to bypass or manipulate feedback routing
- Use automated bots or scripts to overload the system
We reserve the right to suspend or terminate accounts that violate these guidelines, with or without notice.
6. Feedback Collection & AI Usage
By using our feedback tools, you acknowledge that:
- Responses may be anonymous unless the respondent voluntarily identifies themselves.
- Our AI analyzes tone and keywords to trigger smart replies.
- The business owner is responsible for configuring review prompts or public links in a compliant manner (e.g., Google review terms).
7. AI-Assisted Review Writing and Third-Party Review Platform Compliance
QuickFeedback.ai offers an AI-assisted review writing feature that helps customers draft reviews based on their own experiences and input. By using this feature, you acknowledge and agree to the following:
- The customer retains full control over, and responsibility for, the final content submitted to any third-party review platform (including but not limited to Google). QuickFeedback.ai does not submit, post, or publish reviews on behalf of any user or customer.
- Business owners are solely responsible for ensuring their use of the AI-assisted review writing feature complies with the terms of service and policies of any third-party review platform, including Google's review policies, the FTC's Guides Concerning the Use of Endorsements and Testimonials, and any other applicable laws or regulations.
- QuickFeedback.ai does not guarantee that reviews generated or assisted by our AI will be approved, published, or retained by any third-party review platform.
- MaxIT LLC is not liable for any review removal, account suspension, or penalties imposed by third-party review platforms on businesses or customers arising from the use of the AI-assisted review writing feature.
- You agree not to use the AI-assisted review writing feature to fabricate, misrepresent, or incentivize reviews in violation of applicable laws or third-party platform policies.
8. Subscription Plans and Payments
We offer free trials and paid subscription plans. By subscribing to a paid plan, you agree to recurring billing unless canceled.
- Payments are processed securely through Stripe.
- No refunds are issued after the billing cycle begins unless required by law.
- Plan features and limits (e.g., number of QuickQRs, responses/month) are described on our Pricing page.
9. Intellectual Property
All materials, code, branding, and design used in QuickFeedback.ai are the intellectual property of MaxIT LLC or its licensors. You may not reproduce, modify, or distribute our platform or brand elements without written permission.
10. Data Privacy & Security
We handle personal and feedback data as outlined in our Privacy Policy. By using our Service, you consent to data collection and processing as described.
We follow industry best practices to secure data but cannot guarantee 100% protection. You are responsible for safeguarding access to your account.
11. Data Ownership
As between you and MaxIT LLC, you retain ownership of the feedback data collected through your account ("Your Data"). By using the Service, you grant MaxIT LLC a limited, non-exclusive, royalty-free license to process and store Your Data solely as necessary to provide the Service.
MaxIT LLC may use aggregated, anonymized, and de-identified data derived from all users' feedback for product improvement, analytics, and research purposes. Such aggregated data will not identify you or your customers individually.
You represent and warrant that you have all necessary rights, consents, and permissions to collect and share any data submitted through the Service.
12. HIPAA Disclaimer
QuickFeedback.ai is not a HIPAA-covered entity and does not offer HIPAA-compliant data processing or a Business Associate Agreement (BAA) as a standard part of this Service.
If you operate in a regulated healthcare environment (including but not limited to medical clinics, dental offices, or other healthcare providers subject to the Health Insurance Portability and Accountability Act), you are solely responsible for ensuring that your use of this Service complies with all applicable regulations, including HIPAA.
You agree not to submit, collect, or store any Protected Health Information (PHI) as defined under HIPAA through the Service. MaxIT LLC is not liable for any regulatory penalties, fines, or claims arising from your failure to comply with healthcare data privacy laws.
13. Termination
We may suspend or terminate your access at our discretion, with or without notice, especially in the case of:
- Violation of these Terms
- Abusive or fraudulent behavior
- Repeated non-payment
You may cancel your subscription at any time from your dashboard.
14. AI-Generated Content and Insights
Certain features of QuickFeedback use automated and artificial intelligence technologies to analyze customer feedback and generate summaries, insights, or suggestions. Such AI-generated content is provided for informational purposes only and does not constitute professional, legal, financial, or business advice.
While QuickFeedback aims to provide useful and accurate insights, AI-generated outputs may contain errors, omissions, or inaccuracies. Users remain solely responsible for evaluating feedback, interpreting insights, and making decisions based on their own judgment.
15. No Guarantee of Review Outcomes
QuickFeedback.ai provides tools designed to simplify and encourage the process of collecting customer feedback and directing customers to public review platforms. However, MaxIT LLC makes no representation, warranty, or guarantee of any kind regarding:
- Any increase in the volume, frequency, or rating of Google reviews or reviews on any other third-party platform;
- Any improvement in a business's online reputation, search ranking, or star rating;
- That any customer will complete, submit, or publish a review after using the Service;
- That any review submitted will be approved, retained, or remain published on any third-party platform.
Results will vary based on factors outside MaxIT LLC's control, including customer behavior, third-party platform algorithms, and compliance with third-party policies. Use of the Service does not guarantee any specific business outcome.
16. Cancellation & Refunds (Trial-Based SaaS)
QuickFeedback offers a 7-day free trial. You may cancel at any time during the trial and you will not be charged.
Once the trial ends and a subscription payment is processed, the subscription is non-refundable. You may cancel at any time to prevent future charges.
17. Third-Party Services
We integrate with third-party providers (e.g., Google Analytics, Stripe, email platforms). We are not responsible for their practices. Use of such services is governed by their own policies and terms.
18. Authorized Sales Partners and Representatives
MaxIT LLC may engage authorized individuals or businesses ("Partners") to promote and sell QuickFeedback subscriptions on our behalf. Partners may earn a commission or revenue share as governed by a separate written Partner Agreement between the Partner and MaxIT LLC.
By purchasing or subscribing to the Service through a Partner, you acknowledge and agree to the following:
- Partners are independent of MaxIT LLC and are not employees, agents, or legal representatives of MaxIT LLC for any purpose beyond the scope expressly defined in their Partner Agreement.
- Partners are not authorized to modify these Terms, make promises or representations beyond what is stated on QuickFeedback.ai, or bind MaxIT LLC to any obligation not expressly set forth in these Terms.
- Any verbal or written representations made by a Partner that go beyond the features, pricing, or outcomes described on QuickFeedback.ai or in these Terms are not binding on MaxIT LLC.
- Your subscription to the Service remains subject to these Terms regardless of how you were introduced to or enrolled in the Service.
- MaxIT LLC is not liable for any misrepresentations, errors, or omissions made by a Partner during the sales process.
The relationship between MaxIT LLC and its Partners is governed exclusively by the applicable Partner Agreement and is separate from your relationship with MaxIT LLC as a user of the Service.
19. Data Privacy Laws (GDPR / CCPA)
To the extent applicable, we acknowledge and respect data privacy regulations including but not limited to the General Data Protection Regulation (GDPR) for users in the European Economic Area, and the California Consumer Privacy Act (CCPA) for California residents.
If you or your customers are subject to these or other data privacy laws, you are responsible for ensuring that your use of the Service complies with applicable requirements. 20. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee:
- 100% uptime or uninterrupted availability
- Specific business outcomes or review results
- That all feedback will be received or interpreted accurately
- That the Service will be free from errors or security vulnerabilities
21. Limitation of Liability
To the fullest extent permitted by law, MaxIT LLC and QuickFeedback.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to loss of profits, data, goodwill, or business opportunities.
MaxIT LLC's total cumulative liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the total amount paid by you to MaxIT LLC in the twelve (12) months preceding the claim.
22. Indemnification
You agree to defend, indemnify, and hold harmless MaxIT LLC, its officers, directors, employees, agents, licensors, and successors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of or access to the Service;
- Your violation of these Terms or any applicable law or regulation;
- Your infringement of any third-party right, including intellectual property or privacy rights;
- Any feedback data collected, stored, or transmitted through your account;
- Your failure to comply with the policies of any third-party review platform.
23. Force Majeure
MaxIT LLC shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government action, power failures, internet outages, or failures of third-party infrastructure or services.
In such events, our obligations will be suspended for the duration of the force majeure event. We will make reasonable efforts to notify you and resume normal service as quickly as practicable.
24. Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service (including its validity, breach, or termination) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court. The arbitration shall take place in the State of Connecticut, USA, or by video conference if agreed by both parties.
CLASS ACTION WAIVER: You and MaxIT LLC agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
EXCEPTIONS: Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm, without waiving the right to arbitrate all other claims.
If the arbitration agreement is found unenforceable, or for any claims not subject to arbitration, you agree to the exclusive jurisdiction of the courts located in the State of Connecticut, USA.
25. Severability and Entire Agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. All remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MaxIT LLC regarding your use of the Service and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral, relating to the same subject matter.
26. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Connecticut, USA, without regard to its conflict of law principles. Any disputes not subject to arbitration under Section 24 shall be brought exclusively in the state or federal courts located in the State of Connecticut, USA.
27. Updates to Terms
We may update these Terms from time to time. When we make material changes, we will update the Effective Date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. We recommend checking this page regularly.
